Milasha TV Terms of Use

1. Acceptance of Terms

Milasha TV (“Milasha TV,” “we,” “us,” or “our”) provides the Milasha Smart Web Player together with playlist management, program guide matching, playback and organisation features, account tools, billing tools, and related website functionality (collectively, the “Services”).

By accessing or using the Services, you agree to be bound by these Terms of Use and our Privacy Policy. If you do not agree, do not use the Services.

2. What Milasha TV Is — and Is Not

The Services consist of software only. Milasha TV does not provide, host, aggregate, proxy, transmit, licence, sell or resell any television channels, films, series, live events or other programming. We do not include, publish or maintain any playlist, channel list, line-up or catalogue, and we do not recommend, rank, index or link to sources of media.

Your account is empty when you create it. Nothing plays until you add a source of your own. What you are able to watch — and its quality, availability, language and legality — depends entirely on the source you supply and on your rights to it.

The Milasha Smart Web Player is proprietary, in-house software developed and maintained by Milasha TV. It provides playlist import and management, program guide matching against the entries you supply, adaptive playback, seek and buffer controls, favourites and categories, cross-device synchronisation, multiple profiles, parental controls and diagnostics. These features, and our support of them, are what your subscription pays for.

Milasha TV is delivered through the milasha.tv website and, where offered, our own applications. Unless clearly stated otherwise, we do not guarantee support for third-party apps, modified clients, browser extensions, set-top boxes, or other player software.

3. Your Media and Your Rights

You are solely responsible for the sources you add and for your use of them. Milasha TV does not monitor, verify, curate, endorse, approve or guarantee any source, and we accept no responsibility for the content, legality, availability or quality of anything you choose to play.

You may not use the Services to access, index, store, share or distribute unlicensed, pirated or otherwise infringing material. Doing so is a material breach of these Terms and will result in termination of your account without refund.

4. Eligibility

You must be of legal age to form a binding contract in your jurisdiction and must not be barred from receiving the Services under any applicable law. By using the Services you confirm that you have the right and capacity to enter into these Terms and that your use of the Services is lawful where you are located.

5. Accounts and Security

You are required to create an account to use the player. You agree to provide accurate information and keep your account information current. Each person may register only once; duplicate or fraudulent registrations may result in suspension.

Your login credentials are personal to you. You may not sell, share, rent, transfer, publish or distribute your account credentials or access links. You are responsible for all activity under your account, including activity by anyone who uses your login information.

We may suspend or terminate access if we believe your account is being misused, shared, compromised, used for unauthorised redistribution, used for abusive behaviour, or used in violation of these Terms.

6. User Verification

Milasha TV may require email verification, payment verification, or other account checks before granting or continuing access. We may deny, delay, suspend or terminate access if verification is incomplete, inaccurate, suspicious, or inconsistent with our account rules.

7. Plans, Billing and Payments

Some Services require payment. Plan prices, included player features, subscription terms, billing periods and renewal details are shown during signup, at checkout, and inside your account. Stated prices are in United States dollars and include applicable taxes and fees unless otherwise noted.

Payments are processed by a third-party payment processor. By submitting payment information, you authorise us and our payment processor to charge applicable fees, taxes, renewal charges and other amounts related to your subscription. You also authorise us to charge any valid payment method associated with your account if your primary payment method becomes unavailable or is declined. You agree to keep your payment information current.

Your billing statement will show a descriptor identifying Milasha TV together with our support telephone number, so that you can recognise the charge and contact us directly.

If a payment fails, we may suspend access to your account until the outstanding amount is successfully charged. Any costs arising from failed payments, chargebacks or collection may be your responsibility to the extent permitted by law.

Free tiers, trials and promotional access may be limited by time, account, device, payment method, email, telephone number, household or other fraud-prevention criteria. We may modify, limit, deny or revoke promotional access where we believe it is being abused.

8. Price Changes

We may adjust the prices of our Services within an existing subscription where our own costs of providing the Service change, including development and hosting costs, customer support and payment-processing costs, and taxes, fees or charges imposed by authorities. Cost decreases are taken into account in the same way as cost increases, and any price change is limited to offsetting the actual change in these costs.

We will notify you of any price change at least thirty (30) days before it takes effect, using the contact details associated with your account. If you do not agree to the new price, you may cancel your subscription before the change takes effect. If you do not cancel, your subscription continues at the updated price.

9. Renewals and Cancellation

Subscriptions renew automatically for the same period unless cancelled before the renewal date. You authorise us to charge your payment method for each renewal period until you cancel.

You may cancel at any time, in one step, from your account page. No email, telephone call or request to support is required. When you cancel, your access continues until the end of the period you have already paid for, and your subscription is not renewed afterwards.

10. Refund Policy

After fourteen days, cancelling stops the next renewal charge and your access continues to the end of the period you have paid for. We also review refund requests outside that window on a case-by-case basis, in particular where there has been a verified billing error or a technical fault on our side.

We do not generally refund charges where the difficulty lies with a source you supplied, your device, an unsupported browser, your internet connection, a third-party network, or an outage at the source you chose. To request a refund, contact us through our Contact page.

11. Playback, Guide and Archive Features

Where a source you have supplied exposes an archive, catch-up or time-shift function, the player lets you move through recent programming using built-in seek and scrub controls — pause, rewind, resume, or jump to an earlier point. Milasha TV does not record, store, copy or retain any programming; these controls send requests back to the source you supplied.

Where you supply program guide data, the player matches it to the entries in your playlist. Matching is automatic and approximate; we do not warrant that every entry will match, or that guide data you supply is accurate, complete or current.

Archive depth, guide accuracy and playback quality are properties of the source you chose, not of Milasha TV, and are not guaranteed.

12. Service Availability

We aim to keep the Services available and to resolve faults promptly, but we do not guarantee uninterrupted availability.

Periods of limited or unavailable access are not counted against our availability efforts where they result from: conditions or equipment you are responsible for providing (such as your device, browser or internet connection); the unavailability or failure of a source you supplied; faults in data or telecommunications networks operated by others; unauthorised third-party access or attacks not caused by our intent or gross negligence; scheduled or announced maintenance and updates; or events outside our reasonable control as described in the Force Majeure section.

13. Technical Requirements and Playback Quality

Playback quality depends on many factors outside our control, including your internet connection, browser, device, operating system, network congestion, and the quality, location and capacity of the source you supplied. Some sources work better in one browser than another, and some use codecs that a web browser cannot decode.

You are responsible for having a compatible device, an updated browser, a stable internet connection, and any equipment needed to use the Services.

14. Acceptable Use

You agree not to:

• load, add or play any source that you do not hold the rights or authorisation to access;
• use the Services to access, index, share or distribute unlicensed, pirated or infringing material;
• share, resell, sublicense, redistribute, restream, rebroadcast or publicly display the Services;
• record, scrape, download, extract or archive anything played through the player except where you are expressly permitted to do so by the rights holder;
• reverse engineer, decompile, disassemble, deobfuscate, bypass, disable or interfere with the player, its access controls, PIN controls, payment controls or security tools;
• use bots, scripts, spiders, data-mining tools, automated tools, credential-sharing tools or unauthorised clients;
• attempt to access features or plan tiers you did not purchase or are not authorised to use;
• use the Services for unlawful, abusive, fraudulent, commercial or harmful purposes;
• interfere with our servers, APIs, payment systems or other users, including by introducing viruses or other harmful code.

15. Personal and Household Use Only

Unless we give written permission, Milasha TV is for personal, private, non-commercial use only. You may not use the Services in bars, restaurants, clubs, offices, public venues, commercial premises, events or any public performance environment.

Access is intended for a single household. We may limit the number of devices registered to your account and the number of simultaneous playback sessions permitted under your plan, as described for that plan. We may treat access from an unusual number of devices or locations, or simultaneous use beyond your plan limits, as account sharing or misuse, which may result in restriction, suspension or termination.

16. Content Ratings and Parental Controls

Milasha TV supplies no programming and therefore assigns no ratings. Where a rating or advisory accompanies something you play, it travels with the source you supplied; we do not classify, edit, review or control it, and we cannot guarantee that any rating is present, accurate or complete.

You are responsible for deciding what is suitable for you and for anyone in your household, and for playing material only where it is lawful for you to do so.

To help you manage access, the player provides parental control tools, including PIN protection and separate profiles. You are responsible for keeping your account, PIN and devices secure, for using the available controls, and for supervising who uses your account, including minors. No control system is perfect and you should not rely on these tools alone.

17. Copyright Complaints

Milasha TV respects the intellectual property of others and expects our users to do the same. We host no content, so a complaint will normally concern a source that a user has configured privately within their own account.

If you believe that material accessible through a Milasha TV account infringes your copyright, please send a written notice to our designated agent containing: your contact details; identification of the copyrighted work; identification of the material and enough information for us to locate it; a statement that you have a good-faith belief the use is not authorised; a statement, under penalty of perjury, that the information is accurate and that you are authorised to act on the owner's behalf; and your physical or electronic signature.

On receipt of a substantiated notice we will disable the relevant account or source and notify the account holder, who may submit a counter-notice. We terminate the accounts of repeat infringers.

18. Privacy and User Data

We collect and process information needed to operate the Services, including account information, login information, email address, telephone number where provided, plan selection, payment-related information handled through our payment processor, subscription status, verification status, device and browser information, IP address, user agent, usage logs, playback logs, security logs and support communications.

We use this information to provide the Services, process payments, verify accounts, prevent fraud, enforce these Terms, improve the player, troubleshoot playback issues, provide support, comply with legal obligations and protect Milasha TV and our users. 19. Payment Processor and Third-Party Services

Payments are handled by a third-party payment processor. Card details are collected and stored by that processor, not by us; we do not receive or store your full card number or security code. We do not control every part of third-party payment systems, banks, card networks, email providers or hosting providers, and your use of those services may also be subject to their own terms and privacy policies.

20. Intellectual Property and Software Licence

The Milasha TV website, player, interface, design, layout, logos, software, source code, object code, algorithms, features, text and graphics are owned by Milasha TV or its licensors and are protected by intellectual property laws. Nothing in these Terms transfers any ownership to you.

Subject to these Terms and your payment of applicable fees, Milasha TV grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable and revocable licence to use the player for your own private use for as long as your subscription is active.

You may not copy, modify, adapt, translate, reproduce, distribute, sell, rent, lend, publish, mirror, frame, or create derivative works from any part of the Services; nor reverse engineer, decompile, disassemble, deobfuscate or attempt to derive the source code or underlying logic of the player, except to the limited extent that applicable law expressly permits despite this restriction.

21. Rights in Media You Play

Milasha TV supplies no media and claims no rights in anything you play through the player. All rights — including copyrights, trademarks and broadcasting rights — remain with their respective owners, networks, broadcasters, studios, producers, licensors and other rights holders, and nothing in these Terms grants you any right in them.

A source you have added may change, fail, be renamed or become unavailable at any time. That occurs at the source and is outside our control, and it does not entitle you to a refund except as set out in the Refund Policy above or as required by law.

22. Service Changes, Suspension and Termination

We may modify, suspend, limit or discontinue any part of the Services at any time, including plans, player features, free tiers, payment options, playback features or guide-matching behaviour.

We may suspend or terminate your account if you violate these Terms, fail payment, misuse access, share credentials, attempt to bypass security, abuse support, provide false information, add sources you are not authorised to access, or use the Services unlawfully.

23. Disclaimers

The Services are provided on an “as is” and “as available” basis. We do not guarantee uninterrupted, error-free, secure or perfect service. We make no representation or warranty whatsoever regarding any source you supply, including its availability, accuracy, quality, compatibility, legality or continued existence.

To the maximum extent permitted by law, Milasha TV disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, availability, accuracy and compatibility.

24. Limitation of Liability

To the maximum extent permitted by law, Milasha TV will not be liable for indirect, incidental, special, consequential, exemplary or punitive damages, including loss of data, loss of access, loss of profits, device issues, playback interruptions, source outages, or unauthorised account use.

To the maximum extent permitted by law, our total liability for any claim related to the Services will not exceed the amount you paid to Milasha TV for the affected subscription period.

25. Force Majeure

Milasha TV is not responsible for any failure or delay in providing the Services caused by events outside our reasonable control. Such events include, for example, natural disasters, severe weather, acts or measures of government or authorities, sanctions, war or armed conflict, civil unrest, acts of terrorism, strikes or other labour disputes, embargoes, and failures of power, networks or infrastructure operated by others. During such events, our obligations are suspended for as long as the event prevents or significantly hinders performance.

26. Indemnification

You agree to defend, indemnify and hold harmless Milasha TV, its owners, operators, employees, contractors, service providers and affiliates from claims, damages, losses, liabilities, costs and expenses arising from your use of the Services, the sources you add, your violation of these Terms, your account activity, or your violation of law or third-party rights.

27. Legal Compliance, Export and Sanctions

You are responsible for complying with all laws applicable to your access and use of the Services, including laws related to online services, payments, account use, privacy and media access in your location.

The Services are operated from the United States and are subject to United States law, including export control and economic sanctions regulations. You represent that you are not located in, and are not ordinarily resident in, a country or region subject to comprehensive United States sanctions, and that you are not a person with whom United States persons are prohibited from dealing. We may refuse, suspend or terminate access where required to comply with those rules.

28. Changes to These Terms

We may update these Terms from time to time. When we make changes, we will update the effective date and post the revised version, and where the change is material we will give notice through the website, your account area or email. Continued use of the Services after changes means you accept the updated Terms.

29. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles, unless applicable law requires otherwise. The courts located in Los Angeles County, California shall have jurisdiction, except where applicable law gives you the right to bring proceedings elsewhere.

30. Severability and Entire Agreement

If any provision of these Terms is found unenforceable, that provision will be limited or removed to the minimum extent necessary and the remaining provisions will remain in full force. Our failure to enforce any provision is not a waiver of it. These Terms, together with the Privacy Policy, form the entire agreement between you and Milasha TV regarding the Services.
